Branded Product Policy

1. Purpose and Scope

DeliverFresh Pty Ltd (“DeliverFresh”) is an independent Australian online grocery shopping and home delivery platform. This policy explains our sourcing, listing, sale and fulfilment of genuine third-party branded goods, including where DeliverFresh has no direct agreement with the manufacturer. It applies to our website, applications and other authorised sales channels.

2. Independent Retailer Status

DeliverFresh is not an official or authorised dealer, distributor, franchisee, agent or representative of the third-party brands offered on our platform, unless expressly stated otherwise. Listing or selling a product does not imply brand-owner endorsement, sponsorship, approval, exclusivity or affiliation.

3. Sourcing Channels

We may source branded products through established Australian wholesalers, authorised distributors, independent retailers, commercial resellers, participating local grocery stores and other legitimate suppliers. Some suppliers may have manufacturer approvals; DeliverFresh does not necessarily have those approvals itself. We will not knowingly source counterfeit, prohibited or unlawfully supplied goods.

4. Legal Framework

Australian law can permit independent resale of genuine branded goods without a direct manufacturer dealership. Whether a particular resale is lawful depends on the facts. Relevant laws include the Trade Marks Act 1995 (Cth), including the section 122A defence where its conditions are met; the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth); and the Copyright Act 1968 (Cth). This policy does not itself grant resale, trademark or copyright permissions.

5. Authenticity and Supplier Checks

We aim to verify supplier identity, business details and product provenance using reasonable measures appropriate to the product and risk, including purchase invoices, supplier declarations, labels, batch and expiry information and relevant regulatory documentation. We may reject or remove products or suppliers where authenticity, safety or lawful supply is in doubt.

6. Trademarks, Images and Descriptions

Third-party brand names and trademarks may be used to accurately identify genuine goods where legally permitted. All third-party intellectual property remains with its owners. Product photographs, descriptions and promotional content are used only with suitable permission, licence or another lawful basis. We do not present ourselves as an official brand outlet.

7. Product Listings and Prices

DeliverFresh may set its own retail prices, subject to law and applicable agreements. Prices may differ from manufacturer-recommended prices and other retailers. Product descriptions, promotional claims, availability and discounts must be accurate and not misleading.

8. Retail Partners and Fulfilment

Products may be held or sourced by DeliverFresh, procured after ordering, or supplied and packed by independent retail or wholesale partners. Delivery may be performed by DeliverFresh or third-party carriers. Where DeliverFresh is the seller, it retains its applicable consumer law responsibilities. Where a third party is the seller, that arrangement and the seller’s identity must be clearly disclosed.

9. Product Safety and Food Compliance

Relevant goods must comply with applicable Australian product safety, labelling, food safety, allergen, storage, cold-chain, recall, traceability and import/biosecurity requirements. Suppliers and fulfilment partners are expected to meet their legal responsibilities. DeliverFresh may request evidence of compliance.

10. Availability and Substitutions

Availability depends on supplier stock and logistics. If an item is unavailable, we may offer an alternative consistent with the customer’s instructions and applicable law. We will not knowingly substitute a counterfeit or falsely present a substitute as the original brand.

11. Payments and Customer Support

DeliverFresh may collect payments and coordinate ordering, procurement, delivery, customer communications and complaint handling. Outsourcing any part of fulfilment does not remove obligations that apply to DeliverFresh as the seller.

12. Consumer Guarantees and Refunds

Customers retain all applicable rights under Australian Consumer Law, including remedies where consumer guarantees are not met. Nothing in this policy excludes, restricts or modifies rights that cannot lawfully be excluded. Our separate returns and cancellation terms operate subject to those rights.

13. Brand Owner Concerns

Brand owners or authorised representatives may contact DeliverFresh regarding authenticity, trademark or copyright use, product safety or potentially misleading representations. We will assess concerns in good faith and may amend, suspend or remove a listing while investigating.

14. Supplier Responsibilities

Suppliers are expected to provide genuine, lawfully acquired products; accurate product details; required registrations and licences; suitable traceability and recall information; and timely notification of relevant safety or supply concerns. Additional supplier contracts may apply.

15. Transparency and Policy Updates

We aim to make clear that branded products are independently sourced and do not imply manufacturer affiliation. We may update this policy to reflect operational or legal changes; updates do not diminish existing statutory consumer rights.

16. Independent Retailer Declaration

DeliverFresh Pty Ltd is an independent Australian online grocery and home delivery platform. We source genuine branded products through legitimate wholesalers, distributors, retailers and independent supply partners. We are not an official or authorised dealer, distributor or representative of third-party brands unless expressly stated otherwise.
